Judiciary system is the key player in executing the true values of the constitution-Justice Gogoi Northeast-IAS organizes the Justice K N Saikia Memorial Lecture
Guwahati, 28th October: ‘’The constitution of India has been safeguarding the people of this country and the judiciary system is the key player in executing the true values of the constitution’’-Justice Ranjan Gogoi, Judge of the Supreme Court of India has stated in Guwahati today while delivering the Justice K N Saikia memorial lecture, organized the premier institute of leadership education -North East Institute of Advanced Studies.
While interacting with the audience, Justice Gogoi stated that the backlogs plaguing our judicial system have gained us disrepute in the international community. Let us take stock of the hard facts. Against the 900 seats available in different High Courts of the country, almost 250 are vacant. About 15,000 courts at the district and sub-divisional levels are functioning against the sanctioned number of about 18,000. The pendency in the district and subordinate courts is a staggering figure of 2.68 crores.
He further stated that the National Consultation for Strengthening the Judiciary towards Reducing Pendency and Delays was held in New Delhi in October 2009 to facilitate an immediate solution to the worrisome arrears of cases in Indian courts. The participants at the Consultations identified two major goals for judicial reform - increasing access to justice by reducing delays and arrears in the justice delivery system, and enhancing accountability through structural changes and by setting performance standards and capacities. It also formulated four strategic initiatives of policy changes, re-engineering procedure, human resource development, and leveraging information and communications technology.
Speaking on the right to Privacy Justice Gogoi stated that he right to privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21 and as a part of the freedoms guaranteed by Part III of the Constitution. He has also highlighted the importance of this act in line with the personal choices, transgenders, and other relevant subjects.
While responding to a question of audience on right to education and safer environment, Justice Gogoi has highlighted the importance of the sustainable development goals. He concluded his lecture stating that the enormous challenges facing us today, combined with the pressing demands of the future, are compelling us to rethink and reassess our existing jurisprudence, to effectively deal with the increasing complexity of our problems. Justice Gogoi acknowledged the leadership shown by the North East Institute of Advanced Studies in bringing civil societies, academia, press, media and youth of northeast India in creating a transformation and responsible society through its mission-100.
He expressed his confidence on the Mission-100, which aims to produce 100 civil servants and responsible leaders from the Northeast region in 5 years time. The event was attended by the Justice Ajit Singh, Chief Justice, Gauhati High court, all the current sitting judges and retired judges, high level dignitaries from the Government of Assam, political parties.
